Terms of Service

Plain-English summary: CrankyGarage is a vehicle recordkeeping and informational service. Use it responsibly, keep control of your account, verify safety-critical vehicle information independently, and do not use the Services to harm people, systems, or other users.
These Terms of Service ("Terms") govern your access to and use of websites, applications, APIs, and other services provided by CrankySoftware LLC, including CrankyGarage (collectively, the "Services").
By creating an account, accessing the Services, or using the Services, you agree to these Terms. If you do not agree to these Terms, do not use the Services.
1) About CrankySoftware
The Services are provided by:

References to "CrankySoftware," "we," "us," or "our" mean CrankySoftware LLC.
2) Eligibility
You must be at least 13 years old to use the Services.
If the law where you live requires you to be older to enter into these Terms without parental or guardian consent, you must meet that requirement or obtain the required consent. You may not use the Services if applicable law prohibits you from doing so.
3) Your account
Some Services require an account. You agree to:
- Provide accurate information
- Keep your account information reasonably current
- Protect access to your devices and authentication credentials
- Promptly notify us if you believe your account has been compromised
- Accept responsibility for activity conducted through your account where permitted by law
You may authenticate using supported third-party identity providers. Your relationship with those identity providers is governed by their own agreements and policies.
We may take reasonable steps to verify account ownership before completing sensitive requests, including email changes, account recovery, data exports, or account deletion.
4) CrankyGarage
CrankyGarage is a digital vehicle information and recordkeeping service. Depending on your account, device, platform, and subscription, features may include:
- Vehicle profiles
- VIN decoding
- Odometer history
- Tire and tire-pressure records
- Maintenance and service histories
- Vehicle telemetry
- Diagnostic information
- Service reminders
- Documents and media
- Vehicle knowledge-base features
- AI-assisted document and vehicle information features
- Other vehicle-management functionality
Features may change over time. We do not guarantee that every feature will always be available on every platform, vehicle, device, account type, or geographic region.
5) Important vehicle and safety disclaimer
Vehicle information presented through the Services may be incomplete, inaccurate, outdated, or inappropriate for a particular vehicle. This includes information involving:
- Tire pressures and tire specifications
- Fluid specifications
- Torque specifications
- Maintenance intervals
- Diagnostic trouble codes
- OBD2 data and vehicle telemetry
- Repair procedures
- Suspension settings
- Service recommendations
- AI-generated responses
- Third-party vehicle specifications
Always verify safety-critical information using authoritative information applicable to your specific vehicle. You are responsible for determining whether a vehicle is safe to operate.
Do not perform repairs, adjustments, or other work beyond your training, tools, or ability.
Do not interact with the Services in a manner that distracts you while driving, riding, operating, servicing, or otherwise controlling a vehicle.
6) VIN and vehicle data
You may submit VINs and other vehicle information to use supported features. You represent that you are authorized to create, store, or manage the vehicle records you submit.
Vehicle information obtained through VIN decoding or third-party data sources may contain errors. CrankySoftware does not guarantee the completeness or accuracy of third-party vehicle data.
7) Connected devices and telemetry
The Services may support OBD2 adapters, TPMS devices, Bluetooth peripherals, or other vehicle-related devices. Device compatibility is not guaranteed.
Information received from connected devices may be affected by device quality, vehicle compatibility, sensor accuracy, communication failures, software or firmware issues, installation, calibration, or environmental conditions.
You remain responsible for independently confirming safety-critical measurements.
8) AI-assisted features
Some Services may provide AI-assisted search, summaries, responses, document analysis, or similar functionality.
AI-generated content may be inaccurate, omit important information, misinterpret uploaded documents, produce outdated information, or present incorrect technical conclusions.
AI output is provided for informational purposes only. You should independently verify important information, particularly before making decisions involving vehicle operation, maintenance, repairs, safety, finances, warranties, or legal rights.
CrankySoftware does not guarantee that AI-generated content is accurate, complete, or suitable for a particular purpose.
9) Your content
"Your Content" means information, documents, photographs, videos, notes, vehicle records, and other material that you submit to the Services.
You retain ownership of Your Content.
By submitting Your Content, you grant CrankySoftware a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, display, transform, and otherwise use Your Content only as reasonably necessary to:
- Provide the Services
- Perform functionality you request
- Store and synchronize your information
- Generate previews or searchable representations
- Process documents
- Provide AI-assisted features you invoke
- Back up information
- Protect and secure the Services
- Comply with legal requirements
This license ends when the applicable content is deleted from our active systems, except to the extent copies remain temporarily in backups or retention is required by law.
You represent that you have the rights necessary to submit Your Content and authorize the processing described in these Terms and our Privacy Policy.
10) Prohibited content
You may not upload or use the Services to store or distribute content that:
- Violates applicable law
- Infringes intellectual-property rights
- Violates another person's privacy rights
- Contains malicious software
- Is intended to attack, compromise, or disrupt systems
- You do not have the right to possess or process
- Is otherwise used in violation of these Terms
We may remove content where reasonably necessary to protect users, the Services, third parties, or our legal rights.
11) Acceptable use
You agree not to:
- Attempt to gain unauthorized access to the Services
- Circumvent authentication, usage limits, subscription restrictions, or security mechanisms
- Defeat or bypass bot-detection or abuse-prevention systems
- Probe or test vulnerabilities without authorization
- Introduce malware or harmful code
- Interfere with operation of the Services
- Use automated tools in a manner that creates unreasonable load
- Scrape or harvest information contrary to applicable law or our instructions
- Impersonate another person
- Use another user's account without authorization
- Use the Services for unlawful purposes
- Reverse engineer portions of the Services except where applicable law expressly permits it
- Use the Services to infringe another person's rights
We may implement reasonable technical limits to prevent abuse or protect system availability.
12) Usage limits
Some Services or plans may include limits relating to:
- Number of vehicles
- Storage and documents
- File sizes
- AI usage
- API requests
- Telemetry records
- Tire-pressure records
- Open conversations
- Processing limits
- Other features or resources
Usage limits may vary by plan. Attempts to intentionally bypass or defeat applicable limits may result in restriction or suspension of the affected feature or account.
13) Subscriptions and paid services
Certain features may require payment or a subscription. Prices, subscription periods, renewal terms, and included functionality will be presented before purchase.
Purchases made through Apple, Google, or another application marketplace are also subject to that marketplace's applicable terms.
Unless otherwise stated:
- Subscriptions may automatically renew until canceled.
- You are responsible for canceling before renewal if you do not want the subscription to renew.
- Cancellation generally stops future renewals but does not retroactively refund previously charged periods.
- Refunds for application-store purchases are generally handled according to the applicable store's policies.
- Taxes may be added where required.
We may change pricing or plan features prospectively. Where required, we will provide notice before a pricing change affects an existing subscription.
14) Free and trial services
We may offer free plans, trials, promotional functionality, or beta features. These offerings may have additional limitations and may be modified or discontinued.
Unless prohibited by law, we may change eligibility, functionality, usage limits, or availability of free or trial Services.
15) Account deletion
You may request deletion of your account through available account-management functionality. We may require verification before completing an account-deletion request.
Deleting an account may permanently remove:
- Vehicle profiles
- Service records
- Tire and odometer histories
- Uploaded documents and images
- Notes
- AI-related indexes or derived information
- Other information associated with the account
You are responsible for exporting or retaining any information you wish to keep before completing deletion.
Some information may remain temporarily in backups or may be retained where required for legal, accounting, fraud-prevention, security, or dispute-resolution purposes.
16) Third-party services
The Services may interact with third-party products and services such as:
- Authentication providers
- Application stores
- Vehicle-data providers
- Cloud infrastructure providers
- Cloudflare Turnstile
- Analytics and diagnostic providers
- Email providers
- AI and document-processing providers
- Connected vehicle devices or peripherals
Third-party services are controlled by their respective providers. CrankySoftware is not responsible for third-party services, products, availability, content, policies, or practices.
Your use of a third-party service may be subject to separate terms and privacy policies.
17) Privacy
Our Privacy Policy explains how we collect, process, disclose, retain, and protect personal information.
By using the Services, you acknowledge that information will be processed as described in our Privacy Policy.
18) Intellectual property
Except for Your Content and third-party materials, the Services and their underlying software, designs, graphics, trademarks, text, interfaces, databases, APIs, documentation, and other materials are owned by or licensed to CrankySoftware and are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of CrankySoftware intellectual property to you.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose.
19) Feedback
If you voluntarily provide suggestions, ideas, or feedback concerning the Services, you grant us permission to use that feedback without restriction or compensation to improve or develop our products and services. This does not give us ownership of Your Content.
20) Service availability and changes
We work to keep the Services available and reliable, but uninterrupted operation is not guaranteed.
Services may occasionally be unavailable because of maintenance, updates, network outages, third-party failures, security incidents, infrastructure failures, or events beyond our reasonable control.
We may add, modify, replace, limit, or discontinue features. Where a change materially affects a paid Service, we will provide notice where reasonably practicable or legally required.
21) Beta and experimental features
Some features may be identified as beta, preview, experimental, or otherwise under development. Such features may change without notice, have reduced reliability, produce incorrect results, be discontinued, or have additional usage limitations.
You use beta or experimental features at your own risk.
22) Suspension and termination
We may restrict, suspend, or terminate access to the Services if we reasonably believe:
- You materially violated these Terms
- Your account is being used fraudulently
- Your activity threatens security or availability
- Your use violates applicable law
- Suspension is necessary to protect users or third parties
- We are legally required to do so
Where appropriate, we may provide notice and an opportunity to correct the issue.
You may stop using the Services at any time and may delete your account using available account-management functionality.
Sections that by their nature should survive termination will remain effective after termination.
23) Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
CRANKYSOFTWARE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT TO THE EXTENT PERMITTED BY LAW.
We do not warrant that:
- The Services will always be available
- The Services will be error-free
- Vehicle data will be accurate
- Third-party information will be accurate
- AI-generated information will be correct
- Connected devices will function with every vehicle
- Data will never be lost
- The Services will satisfy every particular requirement
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
24) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRANKYSOFTWARE LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.
This includes, where permitted by law, loss arising from:
- Lost data
- Lost profits
- Loss of use
- Vehicle damage
- Incorrect vehicle information
- Third-party services
- Connected devices
- AI-generated content
- Service interruption
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRANKYSOFTWARE'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (1) THE AMOUNT YOU PAID CRANKYSOFTWARE FOR THE APPLICABLE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (2) USD $100.
Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.
25) Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless CrankySoftware LLC and its members, officers, employees, contractors, and agents from claims, damages, liabilities, losses, and reasonable expenses arising from:
- Your unlawful use of the Services
- Your material violation of these Terms
- Your infringement of another person's rights
- Content you submit without appropriate authorization
This obligation does not apply to the extent a claim results from CrankySoftware's own misconduct or where indemnification is prohibited by applicable law.
26) Governing law
Except where consumer-protection law requires otherwise, these Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles.
Subject to applicable consumer rights, disputes that cannot be resolved informally will be brought in a court of competent jurisdiction located in King County, Washington.
Nothing in this section prevents you from exercising rights granted by mandatory laws in your jurisdiction.
27) Resolving concerns
Before filing a formal claim, we encourage you to contact us and attempt to resolve the issue informally. Nothing in this section limits any right that cannot legally be waived.
28) Changes to these Terms
We may update these Terms as the Services, our business, or applicable requirements change. We will update the "Last updated" date when changes are made.
If changes materially affect your rights, we may provide additional notice by email, in the application, or through the Services.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law. If you do not agree to revised Terms, you should stop using the Services.
29) Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
30) No waiver
Failure to enforce a provision of these Terms does not waive our right to enforce it later.
31) Entire agreement
These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular Service or subscription, constitute the agreement between you and CrankySoftware concerning use of the Services.
